The General Provisions Act Wabo is the basis for many of the permits relating to the physical living environment. Within a project, Wabo makes it possible to perform different activities (construction, installation, assembly, use) with one all-in-one Permit for Physical Aspects.
The Dutch Act 'Wabo' that lays down the rules for granting an All-in-one Permit for Physical Aspects The Act enables members of the public and companies to use one transparent procedure to apply to one competent authority for permits for activities that impact on the physical environment. The Act replaced around 25 former separate permits for such matters as construction, spatial planning, listed buildings and the environment by a single one-stop-shop permit covering all activities.
The starting point of the Wabo is that an all-in-one Permit for Physical Aspects is prepared with the regular procedure of title 4.1 General Administrative Law Act (Awb). In some exceptions the extended procedure dept. 3.4 Awb applies.
The Wabo offers various options for obtaining the all-in-one Permit for Physical Aspects for a project.
The Wabo covers a number of activities for which an all-in-one Permit for Physical Aspects is required. A project can consist of one or more activities. These activities can be divided into three main groups.
The general rule (art. 2.4, section 1 Wabo) is that the municipal executive of the municipality where the project concerned will mainly be implemented assesses an application for an all-in-one Permit for Physical Aspects. In special situations, it is necessary to deviate from the general rule.
In other Acts than the Wabo, it can be determined that authorisations in specific cases are a compulsory part of the all-in-one Permit for Physical Aspects.
